Applicants over 44 may qualify for an Age exemption to apply for an Employer Sponsored ENS186 permanent residency visa

The maximum age limit for an applicant to apply for an ENS186 employer sponsored permanent residency visa is 44 UNLESS the applicant qualifies for an exemption:

For the ENS186 Direct Entry stream, applicants over 44 years of age may be eligible to apply if they fit in one of the following categories:
(a)  academic applicants;
(b)  science applicants;
(c)  Subclass 444/461 workers.

For the ENS186 Temporary Residence Transition stream, applicants over 44 years of age may be eligible to apply if they fit in one of the following categories:
(a)  academic applicants;
(b)  regional medical practitioner applicants;
(c)  science applicants;
(d)  Subclass 457/482 workers; *
(e)  transitional 457 workers under 50.

*If the applicant fits into category (d) Subclass 457/482 workers, the applicant may qualify for the age exemption to apply for the ENS186TRT employer sponsored permanent residency visa if:

  • the applicant’s nominated occupation is on the relevant skilled list of occupations for the ENS186 visa: https://www.legislation.gov.au/Details/F2019L00275 and
  • the applicant worked for their sponsoring employer for a period of 3 years in the same nominated occupation and
  • At all times during those 3 years the applicant held a 457 or 482 visa and
  • For each of the 3 years the applicant worked, the applicant was paid equal to or greater than the Fair Work high income threshold (FWHIT) which is currently approx. $148,700 (2020)
